AGREEMENT TO OUR LEGAL TERMS

Welcome to Property Krowd - Trading name of Krowd Group Limited (15829110). We're the folks behind this website (propertykrowd.com) and other related services that follow these legal terms (the "Legal Terms"). We're registered in England 71-75, Shelton Street, Covent Garden, London, WC2H 9JQ

Our mission is to provide tools that help both tenants and landlords enhance the quality of their homes. If you need to reach us, shoot us an email at help@propertykrowd.com or drop us a letter at 71-75, Shelton Street, Covent Garden, London, WC2H 9JQ.

These Legal Terms are an important agreement between you (whether you're an individual or representing a group) and Property Krowd. They govern your use of our Services. By using the Services, you confirm that you've read, understood, and agree to follow these Legal Terms. If you don't agree with all of them, please don't use the Services and stop using them immediately.

We'll let you know in advance about any planned changes to the Services you're using. The updated Legal Terms become effective when posted or when we notify you at legal@propertykrowd.com, as mentioned in the email. By continuing to use the Services after changes, you're agreeing to the updated terms.

Our Services are designed for users aged 13 and above. If you're a minor (usually under 18), you need your parent or guardian's permission and supervision to use the Services. If you're a minor, make sure your parent or guardian reads and agrees to these Legal Terms before you dive into the Services.

It's a good idea to print a copy of these Legal Terms for your records.

TABLE OF CONTENTS

1. WHAT WE OFFER

The information you get from using our Services isn't meant to be shared with or used by anyone in a place where it goes against the law or regulations. It shouldn't make us break any rules or require us to register in that area. If you choose to use our Services from somewhere else, it's up to you to make sure you're following the local laws, if there are any.

2. OUR INTELLECTUAL PROPERTY RIGHTS

Ownership of our creations

We own or have the right to use all the creative stuff in our Services – that includes source code, databases, software, designs, audio, video, text, pictures, and graphics (all the 'Content'). We also own the trademarks, service marks, and logos you see around here (the 'Marks').

Copyright and trademark laws protect our Content and Marks, not only in the United States but worldwide. You can use the Content and Marks in the Services for your personal, non-commercial use, but remember, they come 'AS IS.'

Your rights to use our Services

As long as you stick to these Legal Terms, especially the 'PROHIBITED ACTIVITIES' section below, we grant you a limited license to: - Access the Services. - Download or print part of the Content you have proper access to, but only for your personal, non-commercial use.

You can't copy, reproduce, or use any part of the Services, Content, or Marks for commercial purposes without our written permission. If you want to use them differently, just drop us a line at help@propertykrowd.com. And if we ever let you use anything from our Services, make sure to acknowledge us as the owners or licensors and include any copyright or proprietary notice when needed.

We keep all the rights we don't explicitly give you in the Services, Content, and Marks.

If you violate these Intellectual Property Rights, it's a serious breach of our Legal Terms, and your right to use our Services will end right away.

Your stuff and contributions

Before you dive into our Services, make sure you understand what happens with the things you send us or post:

Submissions: If you send us any ideas, questions, or info about the Services ('Submissions'), you're agreeing to let us own and use it however we want, without owing you anything.

Contributions: When you contribute to our Services, like in chats or forums, you're giving us a big license to use, copy, and do pretty much anything we want with what you share. Remember, your Contributions might be seen by other users or on other websites.

Remember, you're responsible for what you send or post. Make sure it's not illegal, harmful, false, or misleading. We have the right to remove or edit anything you post if we think it breaks these Legal Terms or harms our Services. If we do that, we might also suspend your account or report you to the authorities.

Dealing with copyright issues

We respect the copyrights of others. If you believe something on our Services is violating your copyright, check out the 'COPYRIGHT INFRINGEMENTS' section below.

3. YOUR RESPONSIBILITIES AS A USER

When you use the Services, you promise that: (1) the info you give us during registration is true, accurate, and up-to-date; (2) you'll keep your info accurate and update it when needed; (3) you're legally allowed to use the Services and agree to follow these Legal Terms; (4) you're at least 13 years old; (5) if you're a minor, you got your parent's permission to use the Services; (6) you won't use any sneaky automated tricks to access the Services, like using a bot or script; (7) you won't use the Services for anything illegal or unauthorized; and (8) your use of the Services won't break any laws or rules. If you give us info that's not true, accurate, current, or complete, we can put your account on hold or shut it down. We might also say no to any current or future use of the Services (or part of them).

4. REGISTERING AS A USER

To use the Services, you might need to sign up. Keep your password a secret and take charge of what happens with your account. If we think the username you pick is not cool, too rude, or just not right, we can change it or ask you to pick a different one.

5. MAKING PURCHASES AND PAYMENTS

We accept these ways to pay:

- Online payments

When you buy something through the Services, make sure your payment and account details are up-to-date. It's important to keep things like your email, payment method, and card expiration date current. We might add sales tax to what you buy, and we can change the prices whenever. All payments need to be in Pound Sterling.

You're responsible for paying the prices and any shipping fees that are in effect when you buy something. By placing your order, you're giving us the OK to charge your chosen payment method. If you're getting something regularly, we can keep charging your payment method without asking every time, until you cancel. If there's a mistake in the price, we'll fix it, even if we've already got your money.

We might say no to an order on the Services. We can decide how much you can buy, either per person, household, or order. This might include orders from the same customer account, payment method, or with the same billing or shipping details. If we think an order looks like it's from a dealer, reseller, or distributor, we can say no to it.

6. CANCELING YOUR SUBSCRIPTION

Once you buy something, you can't get your money back. If you want to stop using our stuff, you can cancel your subscription anytime by logging into your account. Your cancellation kicks in at the end of the time you already paid for.

If you're not happy with what we offer, shoot us an email at help@propertykrowd.com.

7. USING SOFTWARE

Sometimes, we might give you software to use with our Services. If the software comes with its own rules ('EULA'), those rules are what you follow. If there's no EULA, we give you a limited, temporary, personal, and non-transferable permission to use the software only with our Services and as these Legal Terms say. The software and any info that comes with it are given 'AS IS,' without any promises that it'll work perfectly. You take all the risks that come with using the software. You can't copy or share the software unless the EULA or these Legal Terms say you can.

8. THINGS YOU SHOULDN'T DO

When you use the Services, stick to what it's meant for. Don't use it for anything else, especially not for making money, unless we say it's okay.

As a user, promise not to:

  • Collect data from the Services to create databases without asking us first.
  • Trick or try to get sensitive info like passwords from us or other users.
  • Mess with the security features of the Services or try to break any rules.
  • Say bad things about us or harm our reputation.
  • Use info from the Services to bother or harm someone else.
  • Misuse our support services or make up fake reports about bad behavior.
  • Break any laws or rules when using the Services.
  • Do things that mess with how the Services work or stop others from using them.
  • Upload viruses or other harmful stuff, spam, or try to mess with the Services' operation.
  • Automate using the Services, like using scripts to post comments or messages.
  • Remove copyright or ownership info from any content.
  • Pretend to be someone else or use someone else's username.
  • Upload stuff that tries to collect info without people knowing (like spyware).
  • Disrupt or bother the Services or connected networks.
  • Bother or threaten our employees or agents.
  • Try to get around any security measures in the Services.
  • Copy or mess with the software that makes the Services work.
  • Try to figure out the inside of the Services' software, unless it's allowed by law.
  • Use automated systems, like bots, to access the Services.
  • Use the Services for anything that competes with us or to make money.
  • Advertise or sell things on the Services.
  • Sell or give away your profile to someone else.

9. YOUR CONTRIBUTIONS TO THE SERVICES

The Services might ask you to join discussions, share thoughts, or be part of blogs, forums, or other features. You can create, submit, post, or share content and materials (called 'Contributions') like text, videos, photos, or comments. Others using the Services and even people on other websites might see your Contributions. So, keep in mind that what you share isn't private.

When you share Contributions, you promise:

  • Your Contributions won't break any rules or rights of others, like copyrights or trademarks.
  • You own or have permission to use what you share, including any names or images of people.
  • You got permission from everyone in your Contributions to use their names or images.
  • Your Contributions are truthful and not misleading.
  • Your Contributions aren't spam, ads, or anything shady.
  • Your Contributions aren't offensive, mean, or break any laws.
  • Your Contributions don't bully, threaten, or promote violence.
  • Your Contributions follow the laws about child safety and don't violate anyone's privacy.
  • Your Contributions don't include hurtful comments about race, gender, or other sensitive topics.
  • Your Contributions stick to the rules in these Legal Terms and follow the law.

Breaking these rules means breaking these Legal Terms and might lead to losing your right to use the Services.

10. YOUR CONTRIBUTION RIGHTS

When you share your Contributions on the Services or link your account to social networks, you're giving us permission to use them. You're saying we can use, share, and do lots of things with what you share, like showing it to others, using it for ads, or even making new things from it. This permission is for any purpose, whether it's commercial or just to get the word out, and it lasts forever.

This permission covers any way of using your Contributions, and it includes your name, company name, trademarks, and more. You're giving up any special rights you might have in what you share. But remember, you still own what you share, and we're not taking that away from you.

We won't mess with your ownership of what you share, and we're not responsible for what you say. If there's something you don't want us to use, it's up to you to keep it to yourself. We might make changes to what you share or even remove it, but we don't have to check everything you post.

11. RULES FOR REVIEWS

If you want to leave reviews or ratings on the Services, follow these guidelines: (1) share only if you've personally experienced what you're reviewing; (2) keep it clean—no offensive language, hate speech, or profanity; (3) avoid discrimination based on religion, race, gender, and more; (4) don't talk about illegal stuff; (5) no negative reviews from competitors; (6) don't act like a judge on legal matters; (7) be truthful—no false or misleading statements; and (8) don't rally others to post reviews, good or bad.

We might decide to accept, reject, or remove reviews, but we're not obliged to. We won't check every review, and just because someone finds a review objectionable doesn't mean we'll delete it. Reviews don't mean we agree with them. We won't take responsibility for reviews, and posting one gives us the right to use and share it forever.

12. CONNECTING WITH SOCIAL MEDIA

You can link your account on the Services with other online accounts you have, like those on social media platforms. There are two ways to do this: (1) share your login info with us, or (2) let us access your account based on the terms of that account. You promise that sharing this info won't break any rules or make us pay any fees. When you link accounts, we might see and use the content you've shared on those accounts, like friend lists. We might also get more info from those accounts based on your settings. Remember, your relationship with those third-party service providers follows your agreement with them, not us. We won't check the content you've shared, and we're not responsible for it. You can break this link anytime through your account settings or by reaching out to us.

13. THIRD-PARTY WEBSITES AND CONTENT

The Services may have links to other websites ("Third-Party Websites") and content from other sources ("Third-Party Content"). We don't check these for accuracy or appropriateness, and we're not responsible for them. If you use or access Third-Party Websites or Content, it's at your own risk. Review their terms, privacy policies, and practices. Any purchases from Third-Party Websites are between you and the third party. We're not responsible for those products or services.

14. ADVERTISERS

We let advertisers show their ads on the Services. We only provide space for these ads and don't have any other relationship with advertisers.

15. SERVICES MANAGEMENT

We can, but don't have to: (1) monitor for violations of these terms; (2) take legal action against violators; (3) limit your contributions; (4) remove files or content; and (5) manage the Services to protect our rights and property.

16. PRIVACY POLICY

We care about data privacy. When you use the Services, you agree to our Privacy Policy posted on the Services. If you use the Services outside the UK, you're agreeing to transfer your data to and process it in the UK.

17. COPYRIGHT INFRINGEMENTS

We respect copyrights. If you think something on the Services violates your copyright, let us know. You may be held liable for false claims, so be sure before notifying us.

18. TERM AND TERMINATION

These terms apply while you use the Services. We can deny access for any reason or no reason. We can also terminate your use of the Services at any time without notice. If we do, you can't create a new account.

If your account is terminated, you can't register again. We may also take legal action against you.

19. MODIFICATIONS AND INTERRUPTIONS

We can change, modify, or remove the Services' content at any time without notice. We're not liable for any changes, interruptions, or discontinuance of the Services.

20. GOVERNING LAW

These terms are governed by the laws of England and Wales. Disputes will be settled in London. If you're in the EU and a consumer, you have rights under your country's laws.

21. DISPUTE RESOLUTION

Arbitration is limited to individual disputes. No class actions or representative capacity allowed.

Exceptions to Arbitration

Certain disputes, like those related to intellectual property or seeking injunctive relief, aren't subject to arbitration.

22. CORRECTIONS

There may be errors on the Services. We can correct them without notice. We're not liable for any errors, inaccuracies, or omissions.

23. DISCLAIMER

The Services are provided as-is and as-available. Your use is at your own risk. We disclaim all warranties, express or implied. We're not responsible for: (1) errors in content, (2) personal injury or property damage, (3) unauthorized access to our servers, (4) interruptions or transmission errors, (5) bugs, viruses, or the like from third parties, and (6) errors or omissions in content. We don't endorse third-party products or services and won't be responsible for transactions between you and third-party providers. Use caution.

24. LIMITATIONS OF LIABILITY

We, our directors, employees, or agents won't be liable for any damages, including lost profit or data, arising from your use of the Services. Our liability is limited to the amount you paid us in the six months prior to any cause of action. Certain laws may grant you additional rights.

25. INDEMNIFICATION

You agree to defend, indemnify, and hold us harmless from any claims, including legal fees, arising from: (1) your contributions, (2) use of the Services, (3) breach of these terms, (4) breach of your representations and warranties, (5) violation of third-party rights, or (6) harm to other users. We may assume defense control at your expense.

26. USER DATA

We'll keep data you transmit for Services performance. You're responsible for data loss or corruption. We have no liability for such losses.

27. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES

Your visits, emails, and online forms are electronic communications. You agree to receive electronic communications and accept electronic signatures and deliveries. You waive any rights requiring non-electronic records.

28. MISCELLANEOUS

These terms constitute the entire agreement between you and us. Our failure to enforce any right doesn't waive it. We may assign rights to others. We're not liable for events beyond our control. If any term is invalid, it doesn't affect the remaining terms. No joint venture or agency relationship is created. You waive defenses based on electronic form. For complaints or information, contact us at the provided address.

29. BRAND USE

Purpose of Brand Use

Property Krowd uses the names, logos, and trademarks of social landlords and housing providers solely for the purpose of identifying the organisations being reviewed. This use is strictly limited to enabling residents to accurately identify the housing provider in question and to post their reviews. The appearance of a landlord’s branding or logo on Property Krowd does not imply any affiliation, endorsement, or partnership between the housing provider and Property Krowd, unless otherwise explicitly stated.

User-Generated Content

All reviews and comments on Property Krowd are generated by users of the platform. Property Krowd does not verify the content of user reviews and is not responsible for any statements or representations made within them. However, we encourage users to submit only fair, truthful, and accurate reviews based on their personal experiences. If you believe a review violates our guidelines, please report it to us for further investigation.

Verification of Reviews

Property Krowd is committed to maintaining the accuracy and reliability of the reviews on our platform. We have implemented verification processes to ensure that reviews are submitted by genuine residents of the housing providers being reviewed. This may include requesting proof of residence or cross-referencing with available data. By submitting a review, users agree to provide accurate information and may be asked to verify their identity or their relationship with the housing provider.

Trademark Use

Policy Property Krowd’s use of any landlord’s name, logo, or trademark is for identification purposes only and is not intended to dilute or misrepresent the brand. We take reasonable steps to ensure that the use of trademarks and logos does not mislead users into believing there is any commercial connection between Property Krowd and the housing provider, unless explicitly stated otherwise. If you are a housing provider and believe your trademark is being misused, please contact us. We will review the matter and take appropriate action, which may include adjusting or removing the use of the trademark.

Dispute Resolution

We provide a mechanism for housing providers to raise concerns about the use of their names, logos, and trademarks on our platform. If a housing provider believes that their intellectual property is being misused or that reviews are inaccurate, they may contact us at [Legal Contact Information] with detailed information. Property Krowd will work with the concerned party to resolve the issue promptly and fairly.

Right to Respond

Property Krowd provides landlords and housing providers the opportunity to claim their profile and respond to reviews. By claiming a profile, landlords can actively engage with residents, respond to feedback, and address concerns raised in reviews. This allows for open and transparent dialogue between housing providers and their residents.

Liability Disclaimer

Property Krowd assumes no liability for damages arising from the use of trademarks or logos for identification purposes or for any user-generated content posted on the platform. While we take steps to ensure the accuracy and fairness of the reviews posted on Property Krowd, we are not responsible for the truthfulness or reliability of individual reviews. Property Krowd reserves the right to remove or modify any content that is found to violate these terms.

Free Speech and Consumer Rights

Property Krowd is a platform designed to empower social housing residents to share their experiences with landlords and housing providers. By providing this space, we uphold residents' rights to free speech and transparency, enabling accountability in the social housing sector. Housing providers listed on Property Krowd may be subject to public review as part of this accountability.
